2.The Health Records Act 2001 (Vic) and the Health Privacy Principles (HPPs) in that Act.
Personal information means, information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not and whether the information is recorded in a material form or not.
Included within this definition of personal information, is ‘sensitive information’. Sensitive information is a particular type of personal information which includes identifying health information about you (such as details of your health and medical history or the health services you have received).
You have complete control over your personal information, and are therefore not required to disclose it to us.
However, we may not be able to provide you with the appropriate service, treatment, education or advice, if you do not provide the information requested.

1. How Is Your Personal Information Collected?
We will typically collect your personal information from you, through direct dialogue. Examples of this include, speaking within the appointment time, emails, etc.
Where necessary, we may also collect your personal information from third parties. Examples of third parties include previous and/or current medical experts you see, but only if you have first authorised the exchange of your personal information.
We will only collect and document the personal information you have consented to; or otherwise in accordance with the law.

Your contact details, such as address, email, phone number
Your current symptoms
Any previous diagnosis and/or treatment you have received
Your medical history
Your lifestyle history
Your family's medical history to determine any possible genetic links
Any past medical reports or test results
Your appointment
Any other information required to provide you with assistance.

The reason we collect your personal information, is so to provide you with a service that is both effective and safe. With the aim of doing so in the most appropriate possible way.
By this we mean:
- To provide health services
- To provide you with information regarding the health services
- To help manage your accounts, for administration of our clinical records and practice management system;
- To refer you to other health professionals
eg. your GP or specialist medical practitioners
- To obtain and discuss medical reports and test results from other health professionals and diagnostic service providers (such as X-ray services);

With respect to disclosing and sharing your personal information, you expressly agree that we may disclose your personal information to:
1. Other health professionals involved in the provision of your care
2. Other health professionals involved in the provision of your care, such as your GP or specialist medical practitioners; or
hospitals, clinics, diagnostic service providers, and other organisations involved in the provision of your care,
where this is necessary for your ongoing care and support.
Please Note, that your personal information will not be disclosed to a particular health professional or organisation, without first gaining your consent. Which you do not have to provide.
The only exception to this, is if we are permitted or required to do so, by law. Circumstances which may elicit this, are:
1. Disclosure to comply with our legal obligations, including, but not limited to, where we are required to provide information under a subpoena or Court order or other mandatory reporting requirements under law;
2. To communicate with your private health fund, and other bodies such as Medicare, the Department of Veteran's Affairs, WorkCover, TAC, the Office of the Australian Information Commissioner (if you make a privacy complaint to the OAIC) or the Victorian Health Complaints Commissioner (if you make a health service complaint), as necessary
3. Where we are otherwise authorised or permitted to do so under law, such as where we reasonably believe disclosure is necessary to prevent or lessen or prevent a serious threat to the life, health or safety of any individual, or to public health or safety.
If you are a service provider, we may disclose your personal information to manage our relationship with you.

Accessing and Correcting Your Personal Information

In certain circumstances which are are authorised by the law, we may have to refuse you access to your personal information.
Such circumstances include, where providing access would:
1. Have an unreasonable impact on the privacy of other individuals
2. Pose a serious threat to the life or health of any person or to public health or safety, or giving access would be unlawful.
If you believe that your personal information requires correction, you may request that the information be corrected using our contact details below.
If we refuse your request for access or correction, we will provide you with reasons for the refusal in writing, and details about how you may complain about the decision.

The right to erasure includes the ‘right to be forgotten’.
This right gives you the power to require us to delete your Personal Information in certain circumstances.
It also gives you the power, to request that we return your personal information to you, including, but not limited to where:
1. Your Personal Information is no longer necessary for the purpose for which it was collected
2. You withdraw your consent and there is no other legal ground for processing your data.

Data Security, Protection and Quality
Your personal information will be protected from misuse, loss and interference from unauthorised access and modification.
There are procedures in place for monitoring the security and safety of your data.
If any data breaches occur, you and the appropriate authorities, will be immediately notified. As we are required to do, in order to comply with the mandatory ‘notifiable data breach’ scheme (the NDB scheme) under the Privacy Act.
Examples of an 'Eligible Data Breach' are when:
1. There is unauthorised access to or unauthorised disclosure of personal information, or a loss of personal information, that an organisation holds; and this is likely to result in serious harm to one or more individuals; and the organisation has not been able to prevent the likely risk of serious harm with remedial action.
2. An organisation may take remedial steps to prevent the likelihood of serious harm occurring for any affected individuals after a data breach has occurred, in which case, the data breach is not an ‘eligible data breach’.
To provide assistance, you can ensure that you provide us with your correct details. While also letting us know if you believe the information we have about you is inaccurate, incomplete, out of date or misleading.
As we may take steps to delete or permanently de-identify information that it is no longer needed, for the purpose for which it was disclosed.
